The Story Behind the Case
Our client, a devoted father and professional 18-wheeler driver, was pulled off the road and stopped on the shoulder of I-635 West in Dallas when his truck became disabled. While he was outside his vehicle inspecting the situation, a service truck owned by Oncor Electric Delivery Company and driven by its employee crashed into him with catastrophic force. Evidence at trial revealed the Oncor driver never applied the brakes and was distracted at the wheel.
Our Role
We stepped in on behalf of the driver’s widow and three children, holding the defendant corporation and its employee accountable for an entirely preventable tragedy.
We focused on:
- Retrieving video of the crash to prove the driver’s distraction and failure to brake.
- Demonstrating that the disabled big rig should have been visible, and the Oncor vehicle’s driver bore a duty to maintain safe operation.
- Pressuring Oncor’s defense to confront the fact pattern rather than simply offer a low-ball pretrial settlement. (In this case, the pretrial offer had been around $15 million.)
Throughout the trial, our focus was not just on dollars—but on ensuring this family’s loss was honored, and that safety accountability was enforced.
The Result
The jury returned a verdict of $37.5 million in favor of the family.
This outcome provides the financial security the family needed to move forward, and sends a powerful message: when large-scale service providers compromise safety, they will be held to account.
